These Terms of Service (the "Terms") govern your use of the Juniper & Fire website, including all content, features, and services offered on it (the "Site"). The Site is operated by The Juniper + Fire Collective, LLC, a Utah limited liability company ("Juniper & Fire," "we," "us," or "our").
By using the Site, creating an account, or placing an order, you agree to these Terms, our Privacy Policy, and our Shipping & Returns policy, each of which is part of these Terms. If you do not agree, please do not use the Site.
Please read Section 17 carefully. It requires most disputes between you and Juniper & Fire to be resolved through individual binding arbitration rather than in court, and it waives your right to participate in a class action or jury trial. You may opt out of arbitration within 30 days as described in Section 17.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order or create an account. By using the Site, you confirm that you meet this requirement.
2. Our Marketplace
Juniper & Fire is a curated marketplace. The products on the Site are made and sold by independent artisans ("Artisans"), not by Juniper & Fire. When you buy a product, your contract of sale is with the Artisan who made it. Juniper & Fire operates the Site, presents the Artisans’ work, and supports customer service, but is not the seller, maker, or shipper of the products.
Juniper & Fire collects payment on behalf of Artisans as their limited payment collection agent. Your payment to us satisfies your payment obligation to the Artisan for that order.
Artisans are independent businesses, not employees, agents, or partners of Juniper & Fire. Each Artisan is responsible for their products, including product descriptions, materials, quality, safety, compliance with applicable law, processing, packaging, and shipping. We select Artisans carefully under The Juniper Standard™, but we do not manufacture, inspect every item, or guarantee any Artisan’s products, except as expressly stated in these Terms or our Shipping & Returns policy.
3. Products and Handmade Variation
Product descriptions, photos, materials, dimensions, and processing times are provided by Artisans. We work with Artisans to present their work accurately, but we do not warrant that every description is complete or error-free.
Handmade pieces naturally vary. Stones, wood grain, glazes, dyes, and finishes may differ from the photos, and screen settings can affect how colors appear. These variations are part of the character of handmade work and are not defects. Many pieces are one of a kind and may not be available again once sold.
4. Orders, Pricing, and Payment
Your order is an offer to buy. An order is accepted when the Artisan ships it. We or the Artisan may limit quantities, or refuse or cancel any order, including when a product is unavailable, when there is an error in price or description, or when we suspect fraud. If an order is canceled after you have been charged, you will receive a full refund for the canceled item.
All prices are in U.S. dollars. Prices, products, and availability may change without notice. Shipping costs are calculated at checkout. Applicable sales tax is calculated at checkout and collected as required by law.
Payments are handled by Shopify and its third-party payment processors. By submitting payment, you confirm that you are authorized to use the payment method you provide.
5. Shipping, Returns, and Refunds
Shipping, returns, exchanges, refunds, and damaged or incorrect items are governed by our Shipping & Returns policy and by the Artisan’s return policy shown on the product page at the time of your purchase. We currently ship only within the United States. Title to products passes to you when the Artisan delivers them to the carrier; our Shipping & Returns policy explains what to do if an item arrives damaged.
6. Custom and Made-to-Order Pieces
Custom, personalized, and made-to-order pieces are created after you order and are final sale, except as provided for damaged or incorrect items. You are responsible for the accuracy of any specifications you provide, such as sizes, text, or color choices. Timelines for these pieces are good-faith estimates, not guarantees.
7. Gift Cards and Promotional Codes
- Gift cards may be used only for purchases on the Site. They cannot be redeemed for cash, reloaded, or resold, except where required by law. Gift cards do not expire.
- We are not responsible for lost or stolen gift cards, or for gift cards used without your permission.
- Promotional codes have no cash value, may be subject to additional terms or expiration dates stated in the offer, and may not be combined unless the offer says so. We may cancel promotional codes that are used in violation of their terms or obtained fraudulently.
8. Your Account
You are responsible for providing accurate information, keeping your login credentials confidential, and all activity under your account. Please contact us right away if you believe your account has been used without your permission. We may suspend or close accounts that violate these Terms.
9. Email and Text Messages
If you sign up for marketing emails or text messages, you agree to receive recurring promotional messages from us at the email address or phone number you provide. Consent is not a condition of purchase. For texts, message frequency varies and message and data rates may apply. You can unsubscribe from emails at any time using the link in any email, and from texts by replying STOP. Reply HELP for help. We will still send transactional messages about your orders and account. Our Privacy Policy explains how we handle your information.
10. Reviews and Other Content You Submit
If you post a review, photo, comment, or other content on the Site ("Your Content"), you confirm that it reflects your honest experience, that you own it or have permission to share it, and that it does not violate anyone’s rights or the law.
You keep ownership of Your Content. You grant Juniper & Fire and the relevant Artisan a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, and adapt Your Content, along with the name you post under, to operate and promote the Site and the Artisan’s work. We may edit for length or clarity without changing meaning, and we may decline or remove content that is false, offensive, off-topic, promotional, or otherwise violates these Terms. We do not publish reviews that we know to be fake, and we do not suppress reviews based on whether they are positive or negative.
11. Intellectual Property
The Site and its content, including text, design, graphics, logos, and The Juniper Standard™, are owned by Juniper & Fire or its licensors. Each Artisan owns the designs, artwork, and product images of their work and licenses them to Juniper & Fire for display on the Site.
We grant you a limited, personal, non-transferable right to view and use the Site to shop. You may not copy, reproduce, distribute, or create derivative works from any Site content or any Artisan’s designs or images without written permission, except as allowed by law. Buying a product does not give you any rights to reproduce its design.
12. Prohibited Uses
You agree not to:
- use the Site for any unlawful or fraudulent purpose;
- scrape, copy, or harvest Site content or data by automated means;
- interfere with the Site’s security or operation, or upload viruses or harmful code;
- impersonate any person or misrepresent your affiliation with anyone;
- post false, misleading, or infringing content; or
- contact Artisans through the Site to arrange purchases outside the Site.
13. Third-Party Sites and Services
The Site may link to or rely on third-party websites and services, such as payment processors, carriers, and social media platforms. We do not control and are not responsible for them, and your use of them is subject to their own terms and policies.
14. Disclaimers
Except as expressly stated in these Terms, the Site and all products are provided "as is" and "as available." To the fullest extent permitted by law, Juniper & Fire disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Any warranty for a product is provided by the Artisan, not Juniper & Fire. We do not guarantee that the Site will be uninterrupted, secure, or error-free. Some states do not allow certain disclaimers, so some of these may not apply to you.
15. Limitation of Liability
To the fullest extent permitted by law, Juniper & Fire and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Site or any product. Our total liability for any claim relating to the Site or these Terms will not exceed the greater of (a) the amount you paid for the order giving rise to the claim, or (b) $100. Nothing in these Terms limits liability that cannot be limited under applicable law.
16. Indemnification
You agree to indemnify and hold harmless Juniper & Fire and its owners, employees, and agents from any claims, losses, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms, Your Content, or your misuse of the Site.
17. Dispute Resolution and Arbitration
Informal resolution first
Before starting arbitration or a lawsuit, you and we agree to try to resolve any dispute informally. Send a written notice describing the dispute and the relief you are seeking to the contact information in Section 20. If the dispute is not resolved within 30 days after notice is received, either party may proceed as described below.
Binding individual arbitration
Except as stated below, any dispute arising from or relating to these Terms, the Site, or any purchase will be resolved by final and binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Salt Lake County, Utah, or, at your election, by video conference or in the county where you live. Fees will be paid as provided by those rules. The Federal Arbitration Act governs this section.
Exceptions
Either party may bring an individual claim in small claims court if it qualifies. Either party may also seek relief in court to protect intellectual property rights.
Class action and jury trial waiver
You and Juniper & Fire each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. You and we each waive the right to a jury trial. If this class waiver is found unenforceable as to any claim, that claim will proceed in court, not arbitration, and the rest of this section will continue to apply.
Your right to opt out
You may opt out of this arbitration agreement by emailing us at the address in Section 20 within 30 days after you first accept these Terms, with your name, the email address associated with your account or orders, and a clear statement that you are opting out of arbitration. Opting out will not affect any other part of these Terms.
18. Governing Law and Venue
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. For any dispute not subject to arbitration, you and we agree to the exclusive jurisdiction of the state and federal courts located in Salt Lake County, Utah.
19. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted on this page with a new "Last updated" date and apply to orders placed after that date. Your continued use of the Site after changes are posted means you accept them.

General
These Terms, together with the policies they reference, are the entire agreement between you and Juniper & Fire regarding the Site. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, sale, or reorganization. We are not liable for delays caused by events beyond our reasonable control. Sections that by their nature should survive termination, including Sections 10, 11, and 14 through 18, will survive.
